The new decade has foreseen significant changes reinvigorating the market for biosimilars, opening the way for their accelerated growth in the years to come. This has been substantiated by the vibrant Indian pharmaceutical industry and its burgeoning market for biologics. The Indian jurisdiction has grown to play an important role in the field of biologics and its protection. Furthermore, the Indian guidelines draw a close resemblance between its counterparts in its doctrine of principles and approach. This underlying homogeneity of the guidelines in addition to the lack of market exclusivity makes India a potential market for biosimilars. This talk deals with the patenting of biosimilars in India and the formidable barriers encountered in the process. It also aims to explore the various patentability requirements associated thereof.
Vijay Kumar Makyam is a Senior IP Analyst at ?IP Markets?, a comprehensive IP services Firm established in 2013. He enrolled with the Karnataka Bar in the year 2003. A Postgraduate in Law with specialization in Intellectual Property Rights and Master of Science in Information Technology, he has PG Diploma in Intellectual Property Rights from National Law School of India University, Bangalore. He is also a Faculty at NIMSME (National Institute of Micro, Small and Medium Enterprise), Hyderabad, NIPER (National Institute of Pharmaceutical Education and Research), Hyderabad, and also a Resource Person for University College of Law, Osmania University, JNTU Hyderabad, JNTU Kakinada, Ministry of HRD & Ministry of MSME. He is in charge for registration of copyrights and trademarks, Filing Patent applications and processing them in India as well as coordinating filing and prosecution at USPTO, European Patent office etc. He is instrumental in organizing internal and external seminars and training sessions for IP Markets. He is a Member of INTA (International Trademark Association).
